ConCourt Throws Out Kambwili’s Petition

The Constitutional Court has thrown out an application by Roan Constituency Member of Parliament, Chishimba Kambwili in which he was seeking a stay of the parliamentary election petition in the Ndola High Court.
Mr. Kambwili appealed to the Constitutional Court against High Court Judge, Emelia Sukuntu’s decision to refuse to dismiss the petition against his election victory brought by losing UPND candidate Andrew Kayekesi.
He contended that the petitioner did not comply with the court’s order to pay security for costs on or before
September 21, 2016.
In her ruling Constitutional court judge Annie Sitali dismissed Mr. Kambwili’s application for the stay of Justice
Sikuntu’s decision on grounds that it was wrongly before her court.
