Incarcerated UPND President Hakainde Hichilema has petitioned the Lusaka High Court and the Constitutional Court over his unlawful arrest.
Mr Hichilema has asked the court for an order to cancel his arrest as there are no facts on which reasonable suspicions could have been formed having committed the offence of treason.
Mr Hichilema and five others are also seeking a declaration that section 121(1) of the criminal procedure code which denies the court to grant bail to persons charged with offenses carrying a possible or mandatory capital penalty if such persons have previously been convicted of theft of motor vehicle is ultra-vires and should be declared null and void.
Meanwhile, Lusaka Principal Resident Magistrate David Simusamba has set June 8, 2017 as the date for committing UPND President Hakainde Hichilema’s alleged treason case to the High court for trial.
This follows an application by Mr Hichilema’s lawyers who asked the Magistrate to bring the accused to court ealier than the scheduled date of June 12.
