Court Grants Ponga Liwewe Application To Set Aside Judgment Against Him

The Lusaka high court has granted an application by Football Association of Zambia Outgoing General Secretary Ponga Liwewe in which he asked it to set aside the default judgment entered against him.
This is in a matter where former general secretary of the association George Kasengele has sued the organisation over his unpaid terminal benefits amounting to more than 2 million Kwacha.
On February 22nd 2018, deputy registrar Ruth Chibabuka compelled the football association to pay Kasengele his terminal benefits, salary arrears, damages for loss of usage of funds, interests and costs of proceedings, for failure to file its defence.

But in an affidavit in support of summons to set aside the judgement in default, Liwewe argued that he was unable to enter a defence because he was awaiting instructions from the requisite committee which could not be convened due to national football issues.
The outgoing secretary general also wanted the court to stay the execution of the judgement in default dated 22 February 2018.
