FAZ Divided Over Simataa’s Suspension

Category: Sport
09/03/2010
The Suspension of Zambia Football Coaches Association (ZAFCA) General Secretary, Simataa Simataa from all football activities as announced on Monday by Football Association of Zambia (FAZ) has taken a new twist. FAZ Disciplinary Committee Chairperson, Sunday Nkonde, State Counsel, describes the move as unconstitutional and null and void. He says his committee never sat to hear any complaint leading to the suspension of Simataa Simataa. Nkonde says the FAZ executive or whoever made the decision has no power to suspend an official on disciplinary grounds. He says under article 47 of the FAZ constitution, the only recognized judicial bodies are the disciplinary committee, the FAZ council of appeals committee and the arbitration tribunal. He says it is wrong for the FAZ Executive committee to act as a complainant, prosecutor and judge in the same matter. He has warned whoever is giving legal advice to the FAZ executive to be careful to avoid misleading the executive in to making unconstitutional decisions. This is contained in Nkonde’s letter written to Simataa Simataa made available to MUVI TV sports after Simataa queried the disciplinary Committee Chairperson following his suspension by FAZ General Secretary. And Simataa Simataa has since urged the Football Association of Zambia (FAZ) executive led by Kalusha Bwalya to withdrawal the suspension letter. He says the executive must be magnanimous enough and do the needful following the clarification of the matter by Sunday Nkonde state counsel. Simataa was speaking to MUVI TV Sports.
