THE state has asked the Constitutional court to a set aside the case in which UPND leader Hakainde Hichilema and five others have petitioned the court for unlawful arrest.
The six are seeking for constitutional bail, pending the hearing of their treason case.
Chief State advocate Joel Simachela has argued that the petition should be set aside as it is a duplicity of a similar matter filed before the high court.
Mr Simachela has also asked the high court to stay the proceedings before it pending the determination of the outcome of the matter before the constitutional court.
