Court adjourns GBM’s alleged “proposing violence’ case

The Lusaka Magistrates Court has adjourned the case in which UPND Vice President for Administration Geoffrey Bwalya Mwamba is facing a charge of allegedly proposing violence.

When the matter came up for trial before Lusaka Magistrate Jenipher Bwalya, the prosecution team made an application for an adjournment of the matter stating that they had just received submissions form the defense and that it was too late to respond to the submissions.

Meanwhile in their submissions filed in for arguments of preliminary issues, the defense asked the court to refer the matter to the constitutional court for determination on ground that the indictment infringes on the accused person’s rights to freedom of assembly and association and that it does not disclose any offence as words used are mere political imagery consisting of figurative speech.

The matter comes up on June 1, 2016 for response from the state.
