The Lusaka Magistrates Court has dismissed an application by UPND Running mate Geoffrey Bwalya Mwamba’s lawyers to refer the matter where he is facing charge of alleged proposing violence to the constitutional court.
Earlier in the last sitting, the defence made an application to refer the subject matter to the constitutional court pursuant to article 2 of the amended constitution.
The defence stated that the indictment proposing violence dose not disclose an offence as words uttered by Mr Mwamba were mere political imagery consisting of figurative speech.
When the matter came up for ruling, Principal Resident Magistrate Jenipher Bwalya ruled that it would be inappropriate to refer the matter to the constitutional court as the subordinate court has not yet determined whether the words uttered by Mr Mwamba relate or contain metaphoric or figurative speech.
